Algemene voorwaarden

ALGEMEEN

1. Ethiek en hygiëne staan binnen Tilburg Massage hoog aangeschreven. Wij verwachten van onze cliënten hetzelfde.
2. Tilburg Massage geeft geen medische massages.
3. Cliënt gaat akkoord met deze algemene voorwaarden en privacy statement bij het maken van een reservering of bij het binnentreden van de salon.

UW EN ONZE GEZONDHEID

1. Cliënt is verantwoordelijk voor het doorgeven van relevante informatie m.b.t. zijn/haar gezondheid voorafgaande aan de behandeling.
2. Als er sprake is van lichamelijke of geestelijke aandoeningen, blessures, behandeling door arts/specialist en/of medicijngebruik, dan dient de cliënt dit voor de massage aan de masseur te melden.
3. Als cliënte zwanger is, of in de aanlooptijd is om het te worden, dient zij dit voor de massage aan de masseur te melden.
4. Cliënt wordt aangeraden zijn/haar behandelend arts of specialist te raadplegen alvorens een massage te ondergaan.
5. De masseur kan te allen tijde beslissen de massage niet te starten of voort te zetten als blijkt dat de door cliënt opgegeven aandoening aanleiding geeft tot contra-indicatie.
6. Tilburg Massage zal de privacy regels respecteren betreffende de door cliënt aan Tilburg Massage voor de behandeling noodzakelijk verstrekte persoonsgegevens.

DUO MASSAGES

1. Een duo massage wordt ingepland aan de hand van de beschikbaarheid van onze collega’s. Dit houdt in dat het niet mogelijk is om voorkeur door te geven. Wens je dit wel? Dan kan je online twee aparte massages boeken met voorkeur, graag als twee verschillende boekingen, niet één boeking maken.
2. Je kunt kiezen uit een Sportmassage of een Ontspanningsmassage.

AFSPRAKEN EN ANNULERINGEN

1. Afspraken kunnen tot 24 uur van tevoren kosteloos worden verplaatst of geannuleerd.
2. Indien er een afspraak wordt ingepland die minder dan 24 uur na het boeken plaats dient te vinden (‘last minute’), vervalt het recht op kosteloze verplaatsing of annulering van de afspraak.
3. Bij afspraken die niet tijdig worden geannuleerd, is Tilburg Massage gerechtigd deze volledig in rekening te brengen. Tilburg Massage kan de cliënt daarvoor een factuur of betaalverzoek sturen. Cliënt zal deze factuur of het betaalverzoek betalen binnen de daarbij vermelde termijn. 
4. De wettelijke bedenktermijn van 14 dagen bij koop op afstand is niet van toepassing op massages aangezien er geen product wordt aangeschaft, maar er een dienst wordt geleverd die is uitgesloten van het herroepingsrecht.
5. De vaste tarieven worden kenbaar gemaakt op de tarievenlijst en website.
6. De genoemde tarieven zijn inclusief 21% BTW.
7. In de salon kunt u betalen met een cadeaubon (mits er telefonisch of via WhatsApp een afspraak is gemaakt), contant geld en/of een betaalverzoek (alleen mogelijk indien u beschikt over een Nederlandse bankrekening). Het is niet mogelijk om in de salon te pinnen.
8. Afspraken voor Duo Massages dienen direct vooruitbetaald te worden. Dit kan door middel van een betaalverzoek verstuurd via WhatsApp (alleen mogelijk indien u beschikt over een Nederlandse bankrekening, anders dient er alsnog via de website geboekt te worden).
9. De masseurs van massagesalon Tilburg Massage behouden zich het recht voor een afspraak te annuleren, indien er, naar het oordeel van (één van) de betreffende masseurs, geen sprake is van een hygiënische of veilige situatie.

AANSPRAKELIJKHEID

1. De massage wordt door cliënt op eigen verantwoordelijkheid ondergaan.
2. Voor zover dit op grond van dwingend recht is toegestaan, is Tilburg Massage niet aansprakelijk voor directe schade, indirecte schade, opgelopen letsel of andere schade van welke aard dan ook, tenzij de schade is veroorzaakt door opzet of grove schuld aan de zijde van Tilburg Massage.
3. Tilburg Massage is in geen geval niet aansprakelijk voor schade, van welke aard dan ook, die is ontstaan doordat de masseur is uitgegaan van door de cliënt verstrekte onjuiste en/of onvolledige informatie over zijn/haar gezondheid (zie kopje ‘Uw en onze gezondheid’ bepaling 1 tot en met 5), voor zover dit op grond van dwingend recht is toegestaan. 
4. Indien Tilburg Massage onverminderd het voorgaande aansprakelijk is jegens cliënt, uit welke hoofde dan ook, dan is Tilburg Massage uitsluitend aansprakelijk voor directe schade die cliënt lijdt als gevolg van een aan Tilburg Massage toerekenbare tekortkoming en/of onrechtmatige daad tot het bedrag dat door de aansprakelijkheidsverzekering van Tilburg Massage wordt uitbetaald. Voor zover aansprakelijkheid, om wat voor reden dan ook, niet gedekt wordt door de aansprakelijkheidsverzekering van Tilburg Massage, is de aansprakelijkheid van Tilburg Massage beperkt tot een bedrag ter grootte van de prijs van de behandeling.
5. Tilburg Massage is niet aansprakelijk voor verlies, diefstal of beschadiging van persoonlijke eigendommen die zijn meegebracht naar de salon.

KLACHTENREGELING

1. Klachten over de verrichtte werkzaamheden dienen door de cliënt binnen 8 dagen na ontdekking, doch uiterlijk 14 dagen na het verrichten van de werkzaamheden schriftelijk te worden gemeld aan Tilburg Massage. De klacht dient een zo gedetailleerd mogelijke omschrijving van de tekortkoming te bevatten, zodat opdrachtnemer in staat is adequaat te reageren.

TOEPASSELIJK RECHT EN BEVOEGDE RECHTER

1. Op deze algemene voorwaarden en iedere onderliggende overeenkomst tussen de cliënt en Tilburg Massage is uitsluitend Nederlands recht van toepassing.
2. De rechter in het arrondissement van de vestigingsplaats van Tilburg Massage is exclusief bevoegd om kennis te nemen van eventuele geschillen tussen de cliënt en Tilburg Massage, tenzij de wet iets anders bepaalt.

General conditions (English)

GENERAL

1. Ethics and hygiene are highly valued at Tilburg Massage. We expect the same from our clients.
2. Tilburg Massage does not provide medical massages.
3. The client agrees to these general terms and conditions and privacy statement when making a reservation or entering the salon.

YOURS AND OUR HEALTH

1. The client is responsible for providing relevant information regarding his/her health prior to the treatment.
2. If there are physical or mental conditions, injuries, treatment by a doctor/specialist, and/or medication use, the client must inform the masseur of this before the massage.
3. If the client is pregnant, or in the process of becoming pregnant, she must inform the masseur of this before the massage.
4. The client is advised to consult their treating physician or specialist before undergoing a massage.
5. The masseur can decide at any time not to start or continue the massage if it appears that the condition indicated by the client gives rise to a contraindication.
6. Tilburg Massage will respect the privacy rules regarding the personal data provided by the client to Tilburg Massage that are necessary for the treatment.

DUO MASSAGES

1. A duo massage is scheduled based on the availability of our colleagues. This means that it is not possible to indicate a preference. Do you wish to do this? Then you can book two separate massages online with a preference, please make them as two different bookings, not one booking.
2. You can choose between a Sports Massage or a Relaxation Massage.

APPOINTMENTS AND CANCELLATIONS

1. Appointments can be rescheduled or canceled free of charge up to 24 hours in advance.
2. If an appointment is scheduled to take place less than 24 hours after booking (‘last minute’), the right to free rescheduling or cancellation of the appointment is forfeited.
3. In the case of appointments that are not canceled in time, Tilburg Massage is entitled to charge the full amount. Tilburg Massage may send the client an invoice or payment request for this. The client will pay this invoice or payment request within the specified period.
4. The statutory cooling-off period of 14 days for distance selling does not apply to massages since no product is purchased, but a service is provided that is excluded from the right of withdrawal.
5. The fixed rates are made known on the rate list and website.
6. The mentioned rates are inclusive of 21% VAT.
7. In the salon, you can pay with a gift voucher (provided an appointment has been made by phone or via WhatsApp), cash, and/or a payment request (only possible if you have a Dutch bank account). It is not possible to pay by card in the salon.
8. Appointments for Duo Massages must be paid for in advance. This can be done through a payment request sent via WhatsApp (only possible if you have a Dutch bank account; otherwise, you still need to book through the website).
9. The masseurs of massage salon Tilburg Massage reserve the right to cancel an appointment if, in the opinion of (one of) the relevant masseurs, there is no hygienic or safe situation.

LIABILITY

1. The massage is undergone by the client at their own responsibility.
2. As far as this is permitted under mandatory law, Tilburg Massage is not liable for direct damage, indirect damage, incurred injury, or any other damage of any kind, unless the damage is caused by intent or gross negligence on the part of Tilburg Massage.
3. Tilburg Massage is in no case liable for any damage of any kind that has arisen because the masseur has relied on incorrect and/or incomplete information provided by the client regarding his/her health (see section ‘Your and our health’ provisions 1 to 5), as far as this is permitted under mandatory law.
4. If Tilburg Massage is liable to the client, for any reason, then Tilburg Massage is solely liable for direct damage suffered by the client as a result of a shortcoming and/or unlawful act attributable to Tilburg Massage, up to the amount paid out by Tilburg Massage’s liability insurance. Insofar as liability, for any reason, is not covered by Tilburg Massage’s liability insurance, Tilburg Massage’s liability is limited to an amount equal to the price of the treatment.
5. Tilburg Massage is not liable for loss, theft, or damage to personal belongings brought to the salon.

COMPLAINTS PROCEDURE

1. Complaints about the work performed must be reported by the client in writing to Tilburg Massage within 8 days of discovery, but no later than 14 days after the work has been carried out. The complaint must contain as detailed a description of the shortcoming as possible, so that the contractor is able to respond adequately.

APPLICABLE LAW AND COMPETENT COURT

1. Dutch law applies exclusively to these general terms and any underlying agreement between the client and Tilburg Massage.
2. The court in the district of the registered office of Tilburg Massage is exclusively competent to hear any disputes between the client and Tilburg Massage, unless the law provides otherwise.
